  • Agency: Refers to ABCo Insurance Benefits, which offers health insurance, supplemental insurance, Medicare Advantage, life insurance, and Property and Casualty (P&C) insurance products.
  • Client: Any person who purchases or is interested in purchasing an insurance product offered by the agency.
  • Independent Agent: An individual or entity that markets insurance products on behalf of the agency but is not an employee of the agency.
  • Products: Includes, but is not limited to, health insurance, supplemental plans, Medicare Advantage, life insurance, and Property and Casualty (P&C) insurance.

2. Services Offered

Protection Insurance provides advice and marketing for a variety of insurance products, including:

  • Property and Casualty (P&C) Insurance: Coverage for physical assets and liability, such as home, auto, and other insurance policies.
  • Health Insurance: Individual and family health coverage, both in the private market and under state and federal programs.
  • Supplemental Insurance: Plans that complement primary health coverage by covering expenses not included in the main policy.
  • Medicare Advantage: Alternative plans to Original Medicare that offer additional coverage under private companies approved by Medicare.
  • Life Insurance: Term life insurance, whole life insurance, and other variations.

3. Client Responsibilities

  • Accuracy of Information: Clients are responsible for providing accurate and up-to-date information when applying for an insurance product. Any false or incomplete information may affect the validity of coverage.
  • Payment of Premiums: Clients agree to pay the corresponding premiums in a timely manner. Failure to do so may result in the cancellation of the policy.
  • Policy Review: Clients must read and understand the terms and conditions of their policy, including exclusions and coverage limitations.

4. Independent Agent Responsibilities

  • Legal Compliance: Independent agents must comply with all applicable local, state, and federal laws, as well as with the rules of the insurance companies they represent.
  • Ongoing Education: Agents are required to stay updated on the products they sell and to meet the licensing and certification requirements mandated by law.
  • Confidentiality: Agents must protect the personal and financial information of clients in accordance with applicable data protection laws.
  • Professional Responsibility: Agents shall act with integrity and professionalism in promoting and selling products, ensuring that recommendations made are in the best interest of the client.

5. Relationship with Independent Agents

  • Nature of Relationship: Independent agents are not employees of Protection Insurance, but independent contractors. The agency is not responsible for the actions of agents beyond the guidelines and rules agreed upon in individual contracts.
  • Commissions: Independent agents will receive commissions for product sales according to the terms stipulated in their contract with the agency.
  • Non-Exclusivity: Agents may offer products from other companies, provided they do not conflict with the guidelines established by the agency.

6. Confidentiality and Data Protection

ABCO Insurance Benefits and its agents are committed to protecting the confidentiality of clients’ personal and medical information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and other applicable laws. Data will only be shared with third parties when necessary for the contracting of related products or services.

7. Limitation of Liability

ABCo Insurance Benefits is not responsible for:

  • Issues or denials of coverage by insurance companies.
  • Incorrect decisions or recommendations made by independent agents, unless negligence or deliberate misconduct by the agency is proven.
  • Errors or omissions in the information provided by the client.

8. Policy Cancellation and Termination

Each insurance product has specific cancellation and termination policies, detailed in the particular conditions of each policy. Clients must review these terms and proceed according to the insurer’s guidelines in the event of cancellation.

9. Modifications to the Terms and Conditions

The agency reserves the right to modify these Terms and Conditions at any time. Modifications will be communicated to clients and independent agents and will take effect 30 days after publication.

10. Governing Law and Jurisdiction

These Terms and Conditions will be governed and construed in accordance with the laws of the state of Florida. Any disputes will be resolved in the competent courts of that state.
